The rules for using the Kilowatka app and the Premium subscription.

Who runs Kilowatka
The Kilowatka app and the kilowatka.cz website are run by Jan Piskač. In these terms, “we” means the operator and “you” means the user of the app.

What Kilowatka does and does not do
Kilowatka is an iPhone app. It shows public charging stations in Czechia, charging prices taken from operators’ price lists and, with Premium, an estimate of what charging your car will cost.
Kilowatka does not start charging, does not sell electricity and does not take payments for charging. You make the charging contract with the station operator or with the issuer of the card you pay with, and their terms apply to it.
Prices, estimates and availability
- We take prices from operators’ public price lists. Each one shows its source and the date we checked it. An operator can change a price at any time. The price the operator shows you when you start charging is the one that counts.
- A price we have not verified is marked as unverified or unknown. We never present it as certain.
- The price of a full charge is an estimate. It uses your car’s data, the charging range you choose and the rate. The real price can differ, for example because of charging speed, battery temperature, time or parking fees and rounding.
- We do not yet know station availability for every network. “Unknown” does not mean the station is free.
- If you find a difference, report it from the station detail. We check reports and put verified corrections into the data.
Station data comes from the charging station register of the Czech Ministry of Industry and Trade and from the City of Brno open data (CC BY 4.0 licence). We go through operators’ price lists by hand.
Buying, renewing and cancelling the subscription
- You buy Premium in the app through the App Store. Apple handles the purchase and payment under its own terms. We do not see your payment details.
- The App Store shows you the price, the period length, any trial offer and the renewal terms before you confirm the purchase. What you see there applies.
- The subscription renews automatically until you cancel it. Cancel it in iPhone Settings → your name → Subscriptions (Apple’s guide). Once cancelled, it does not renew again.
- On a new phone, tap Restore Purchases in the app with the same Apple Account.
- You can withdraw from the purchase without giving a reason within 14 days of the purchase confirmation. Apple (Apple Distribution International) sells Premium, so you exercise withdrawal with Apple: in your Apple Account → Purchase History → withdraw from the transaction, or as set out in Apple’s terms. Apple also states there when the right of withdrawal ends. Neither a trial offer nor cancelling renewal replaces withdrawal.
- You request a refund for an App Store purchase from Apple at reportaproblem.apple.com. Apple describes the process and decides on the request (Apple’s guide).
When the app does not work as it should
You have rights for defective performance under the Czech Civil Code and the Consumer Protection Act. These terms do not limit them in any way.
Report a defect in the app or in Premium by email to jan@kilowatka.cz or by letter to the address above. Say what does not work and how you want it resolved, and add the app and iOS versions. We will confirm receipt by email: when you made the complaint, what it contains, which remedy you ask for and where we will send the result. We will handle it without undue delay, within 30 days at the latest, and confirm when and how we handled it; if we reject it, we will give our reasons.
First we remove the defect, usually with an update to the app or the data. If that is not possible, the defect comes back or it is material, you are entitled to a reasonable price reduction or you can withdraw from the contract (for a minor defect, only a price reduction). Apple refunds money for App Store purchases (reportaproblem.apple.com); if Apple does not refund a justified claim, we will, by transfer to the account you give us for that purpose. We are liable for defects in Premium for the whole time of the subscription.
If a dispute with us is not resolved, you can file for out-of-court resolution with the Czech Trade Inspection Authority (ČOI, coi.gov.cz/informace-o-adr) within one year of first raising your claim with us.
Problems with charging itself, starting it or paying for it, are for the station operator.
Licence to use the app
You use the app under Apple’s standard Licensed Application End User License Agreement. We grant you the licence, not Apple. These terms add the rules that are specific to Kilowatka. It does not change your statutory rights as a consumer; its liability limits apply only as far as the law allows.
Liability
Kilowatka is a tool to help you decide. Where and at what price to charge is your decision, based on the operator’s offer. We are liable for damage as provided by law. Nothing in these terms limits liability that cannot be limited towards a consumer.
Apple provides maps, search, routes and purchases. When its services are unavailable, some features may not work.
Changes to the app and these terms
We update the app and its data continuously: we fix bugs, keep prices and stations up to date, add features and respond to changes at Apple, at operators and in the law. You pay nothing extra for changes. If a change would make access to Premium or its use worse in more than a minor way, we will tell you in the app in advance what is changing and from when. You can then end the subscription without penalty within 30 days of the notice or of the change, whichever is later; we will refund the proportionate part of the price for the unused period.
We may change these terms, for example when we add a feature or the law changes. We will publish the new version on this page in advance, with its effective date, and point to it in the app; a change to your disadvantage at least 30 days in advance, unless the law requires the change sooner. If you do not agree with a change, you can stop using the app and cancel the subscription; until the end of the period you have already paid for, the previous terms apply, unless the law provides otherwise.
Governing law
Czech law applies to these terms. As a consumer whose habitual residence is in another EU country, you keep the protection given to you by the mandatory rules of that country. Apple’s licence agreement has its own governing-law clause.
Language versions
The Czech version is binding. This English version is a translation for convenience.
